Paranormal Investigation and the Law
 

Over the last couple of years, legal issues surrounding paranormal investigation have increased. The following links are noteworthy and worth reading in detail if you plan on hosting a paranormal event in your establishment.

Please remember that no matter how 'hobbyist' a group is, that group is still bound by the laws of the land. There are a lot of paranormal investigation groups throughout the UK that tread on dangerous legal ground without knowing it, or thinking that it does not apply to them: make sure that you're not one of those groups!

The Consumer Protection from Unfair Trading Regulations 2008: this is relevant to all groups who employ spiritual 'services' and expect financial renumeration. This legislation came into effect on 26th May 2008 when the Fraudulent Mediums Act of 1951 was repealed. The FMA had itself replaced the Witchcraft Act of 1735.

OFCOM Broadcasting Code 2008 (Section 2.6-2.8): may be classed as relevant to any team wishing to broadcast their findings.

Both the Environment Act 1995 (c. 25) and The Anti-Social Behaviour Act 2003 have impact on field investigations, as do the Public Rights of Way Regulations 2008, which came into force April 2008. The Criminal Justice and Public Order Act 1994 and the The Countryside and Rights of Way Act 2000 also are of importance, especially to the organisations out there who 'forget' to get permission to investigate certain locations. The Clean Neighbourhoods and Environment Act of 2005 also has an effect, especially with the use of artificial lights (ie torches etc).

For venues hosting a paranormal event or investigation, the Occupiers Liability Act should be noted (England and Wales 1984; Scotland 1960; Northern Ireland 1987).

For people wanting to start their own website/team etc., no matter how hobbyist your site is, you're still bound by the Data Protection Act of 1998. Undertanding what it means for you and your members could save you a lot of hassle!
